| "Blogtrottr" <busybee@blogtrottr.com>: Nov 07 10:29PM Understand IslaMs Facebook-Pinnwand Understand IslaMs Facebook-Pinnwand مام النووی رحمہ اللہ نے لکھا: ''فصل إذا قتل بالسیف لم یقتص منہ إلا بالسیف لقولہ... http://www.facebook.com/understandislaam/posts/816843065041118 Nov 7th 2014, 21:53 مام النووی رحمہ اللہ نے لکھا: ''فصل إذا قتل بالسیف لم یقتص منہ إلا بالسیف لقولہ تعالی (فَمَنِ اعْتَدَی عَلَیْکُمْ فَاعْتَدُوا عَلَیْہِ بِمِثْلِ مَا اعْتَدَی عَلَیْکُمْ)ولأن السیف أرجی الآلات فإذا قتل بہ واقتص بغیرہ أخذ فوق حقہ لأن حقہ فی القتل ، وقد قتل وعذب فإن أحرقہ أو غرقہ أو رماہ بحجر أو رماہ من شاہق أو ضربہ بخشب أو حبسہ ومنعہ الطعام والشراب فمات فللولی أن یقتص بذلک لقولہ تعالی (وَإِنْ عَاقَبْتُمْ فَعَاقِبُوا بِمِثْلِ مَا عُوقِبْتُمْ بِہِ ) ولما روی البراء رضی اللہ عنہ أن النبی ﷺ قال: (( من حرق حرقناہ ومن غرق غرقناہ )) (السنن الکبری للبھیقی ۴۳؍۸۔تفسیر النیسا پوری۴۱۳/۱۔تفسیر الرازی۶۲/۳) ولأن القصاص موضوع علی المماثلۃ والمماثلۃ ممکنۃ بہذہ الأسباب فجاز أن یستوفی بہا القصاص ولہ أن یقتص منہ بالسیف لأنہ قد وجب لہ القتل والتعذیب فإذا عدل إلی السیف فقد ترک بعض حقہ فجاز ''۔ (''المہذب''۱۸۶ ؍۲) '' فصل:جب کوئی تلوار سے قتل کرے تو اس سے صرف تلوار کے ساتھ ہی بدلہ لیا جائے گا۔ اللہ تعالیٰ کے اس فرمان کی وجہ سے کہ:''لہٰذا اگر کوئی تم پر زیادتی کرے تو تم بھی اس پر اتنی ہی زیادتی کرسکتے ہو جتنی اس نے تم پر کی ہے''۔(البقرۃ:۱۹۴)چونکہ تلوار قتل کرنے کے آلات میں سے تیز ترین آلہ ہے سو اگر اُس نے اس کے ساتھ قتل کیا مگر اس سے قصاص اس کے علاوہ کسی اور چیز کے ذریعے لیا گیا تو اس سے اس کے حق سے زیادہ لیا گیا کیونکہ اس کے قتل میں تلوار کا حق ہے۔ہوسکتا ہے کہ اس نے (مقتول)کو اذیتیں دے کر قتل کیا ہو تو اگر اُس نے اُسے جلایا ہویا پانی میں غرق کیا ہو یا پتھر سے مارا ہو یا اُسے بلند جگہ سے گرایایا اسے لکڑی سے مارا ہو یا اسے حبس میں رکھا ہو اور اس سے کھانا اور پانی وغیرہ روکا ہو حتی کہ مرگیا تو اس صورت میں وارث کو حق پہنچتا ہے کہ وہ اس( قاتل سے) سے اسی طریقے سے بدلہ لے ۔ اللہ تعالیٰ کے اس فرمان کی وجہ سے:''ور اگر تمہیں بدلہ لینا ہو تو اتنا ہی بدلہ لو جتنی تم پر زیادتی ہوئی''اوراس حدیث کی وجہ سے کہ جو البراء رضی اللہ عنہ نے بیان کی کہ نبی صلی اللہ علیہ وسلم نے فرمایا: ''جس نے جلایا ہم اسے جلائیں گے اور جس نے غرق کیا ہم اسے غرق کریں گے'' (السنن الکبری للبھیقی ۴۳؍۸۔تفسیر النیسا پوری۴۱۳/۱۔تفسیر الرازی۶۲/۳) اس لیے بھی کہ قصاص کی بنیاد مماثلت پر ہے اور مماثلت میں یہ اسباب بھی ممکن ہیں لہٰذا انہی اسباب کے ساتھ قصاص کا پورا کرنا جائز ہے مگر اس کے لیے تلوار کے ساتھ بدلہ لینا بھی جائز ہے کیونکہ اس (قاتل)پر تو قتل واذّیت دینا ثابت ہوچکا ہے لہٰذا اگر وہ (مقتول کا وارث)تلوار کے ذریعے بدلہ لینے کو اختیار کرتے ہوئے اپنے بعض حقوق سے دستبردار ہوتا ہے(یعنی قاتل کو اسی طرح قتل نہیں کرتا کہ جس طرح مقتول کو قتل کیا گیا) تو یہ اُس کے لیے جائز ہے''۔ You are receiving this email because you subscribed to this feed at https://blogtrottr.com If you no longer wish to receive these emails, you can unsubscribe here: https://blogtrottr.com/unsubscribe/gt/nWF8Wm |
