Das Prinzip der Notwendigkeit (Dhuroora)
Wenn es um islamrechtliche Angelegenheiten geht, hören wir hin und wieder von einfachen Muslimen als auch Gelehrten, dass bestimmte Pflichten aufgehoben werden können aufgrund einer Notwendigkeit.
Sie sagen der Islam erlaube es, dass man eine Pflicht unterlässt, wenn die Realität einen dazu zwingt.
Ein Beispiel hierzu ist der gemischte Sportunterricht in den Schulen.
Schwestern ist es nicht erlaubt in ihrem Jilbab, Khimar (usw.) am Sportunterricht teilzunehmen. Daher erlauben einige Muslime den Schwestern breite Hosen zu tragen und gehen damit einen Kompromiss ein.
Fakt ist aber, dass Quran und Sunnah, wenn beispielsweise von der Erlaubnis Schweinefleisch zu essen, die Rede ist, einen ganz spezifischen Fall ansprechen und man daraus keine allgemeine Regel machen und auf anderen Fälle übertragen darf.
Denn die Muslime der heutigen Zeit argumentieren damit, dass der Quran es in Notsituationen erlaubt Schweinfleisch zu verzehren und man deshalb dieses Prinzip auch auf die muslimische Kleiderordnung der Frau übertragen dürfe.
Allah (swt.) spricht im Quran:
"Er hat euch untersagt das natürlich Verendetes das Blut und Fleische des Schweins und dem, worüber etwas anderes als Allah angerufen worden ist. Dann wer gezwungen wird, ohne zu begehren und nicht Übertreter ist, dann gibt es keine Schuld seinerseits; wahrlich, Allah ist Allverzeihend, Begnadender." (Sure 2, Aya 173)
Schauen wir was die klassichen Gelehrten dazu sagen:
Imam al Razi Al Jassas al Hanafi sagt in seinem Ahkam al Quran (vol 1/159): "Hier beinhaltet die Bedeutung von Notwendigkeit die Angst um das Leben und das eigene Leib, wenn jemand Essen vermeidet (das in seinem eigentlichen Wesen verboten ist)...."
Ibn Qudamah al Maqdasi al Hanabli sagt in seinem Al Mughni (9/331): "Der Grund für die Erlaubnis dessen ist die Notwendigkeit sich selber vor dem Untergang zu bewahren, weil diese Maslaha (Angelegenheit) mehr vorteilhaft ist als der Vorteil sich vor dem Übel [gemeint ist das verbotene Essen] zu bewahren..."
Imam Ibn Juzi al Maliki sagt: "... Was die Notwendigkeit betrifft, so ist es die Angst vor dem Tod und es ist nicht notwendig, dass jemand zu einem solchen Ausmaß geduldig ist, dass er seinen eigenen Tod bezeugt [also dafür sorgt, dass er sich dadurch umbringt]". (Al Quanin al Fiqhia p116)
Außerdem selbst wenn es um eine harte Prüfung geht, so hat selbst diese gemäß vielen Glehrten gewisse Bedingungen:
1. Dass es keinen anderen Weg gibt diese Situation zu vermeiden
2. Dass dies nicht die Rechte anderer beeinträchtigt. In anderen Worten man schaut nach einem Ausweg, der nicht nicht anderern schadet.
3. Kufr auszusprechen durch Zwang ist eine Rukhsa (legale Erlaubnis), aber es ist besser, wenn man dies unter Schmerzen von Folter und Tod vermeidet
Die Gelehrten hatten auch Meinungsunterschiede darüber, ob man Alkohol trinken dürfe, wenn man sonst vor Durst sterben würde.
Imam Shafi'i beispielsweise war der Meinung, dass Alkohol den Durst sogar schlimmer machen würde. Andere unterschieden sich auch darin, ob man Medizin einnehmen darf, die verbotene Dinge enthält.
Wie auch immer, alle vier Rechtsschulen und eigentlich der Konsens bestätigen, dass Dhuroora (Notwendigkeit) im rechtlichen Sinne einige Dinge, die verboten sind für einen spezifischen Fall erlauben. Wichtig: Dies ist keine Norm, sondern für sehr spezielle Einzelfälle. Es kann nicht zum eigenen Gesetz gemacht werden. Zudem lässt es sich nicht zu einem normalen Gesetz für eine gesamte Bevölkerung machen.
Zurück zu unserem Beispiel:
So kann kein Gelehrter der Welt eine Schwester von ihrer verpflichtenden Kleiderordnung befreien aufgrund eines schulischen Unterrichts.
Hier sei auf eine Aya im Quran hingewiesen:
"Zu jenen, die Unrecht gegen sich selbst verübt haben, sagen die Engel, wenn sie sie abberufen: "In welchen Umständen habt ihr euch befunden?" Sie antworten: "Wir wurden als Schwache im Lande behandelt." Da sprechen jene: "War Allahs Erde nicht weit genug für euch, daß ihr darin hättet auswandern können?" Sie sind es, deren Herberge Dschahannam sein wird, und schlimm ist das Ende!" (Sure 4, Aya 97)
