THE SCHOLARS OF THE RULERS
I say to all Muslims: "Do not wait for the an open and public word of Truth from the one who enters to the Sultan, dwells in their company and takes their presents."
And if someone of them exposes the truth, rather the majority of them are servants for their Sultans, and as it is said: "Whoever eats their fruit, march [act] after their order."
He [Peace and Blessings be upon him] said: "Whoever resides in the deserts, he becomes ignorant, whoever follows the game, he becomes heedless, and whoever comes to the door of the Sultan, he will suffer a Fitnah."
Narrated by Abu Dawoud on the authority of Ibn 'Abbaas, may Allah be pleased with him.
And the Pious Predecessor, may Allah be pleased with them, were advising take distance from the house of the Sultan, because of it's huge of Fitnah [Trial].
Abdullah ibn al-Mubarak said: "Keep distance from the house of the Ameer, to the best of your ability, may Allah guide you. Do not visit and avoid it, because it is a false evil, it weakens the faith, and will draw you closer to a major sin before you fall, o poor person, in the pit of the well."
These words were said by Ibn Al-Mubarak, may Allah have mercy on him during the time of Haroon Al-Rasheed who defended the Shariah, where he forced Christians to pay the Djizya [Tax], and he send [in a letter] to the King of Romans: "From Haroon the Commandorofthe believers to Naqfur the Roman dog."
He used to perform the Hajj [Pilgrimage] one year, and wage Jihad [another] year. What would their opinion about these rulers of our time who compete for the love of the Crusaders?
What do you think Ibn Al-Mubarak, Al-Fudayl Bin 'Iyad, and other than them, May Allah have mercy upon them would say if they saw the scholars of our time and their presence at the gates of the Sultan and their keenness interest in obtaining favors from them, and the praise made towards them, if it was said about Haroon al-Rasheed it would have fitted him.

عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ لَا يَدْخُلُ الْجَنَّةَ مَنْ كَانَ فِي قَلْبِهِ مِثْقَالُ ذَرَّةٍ مِنْ كِبْرٍ قَالَ رَجُلٌ إِنَّ الرَّجُلَ يُحِبُّ أَنْ يَكُونَ ثَوْبُهُ حَسَنًا وَنَعْلُهُ حَسَنَةً قَالَ إِنَّ اللَّهَ جَمِيلٌ يُحِبُّ الْجَمَالَ الْكِبْرُ بَطَرُ الْحَقِّ وَغَمْطُ النَّاسِ
Abdullah ibn Masud berichtet: "Der Prophet (s.a.s.) hat gesagt: "Keiner wird ins Paradies kommen, der auch nur im Gewicht eines Stäubchens Hochmut in seinem Herzen hat." Da sagte ein Mann: "Ein Mann will doch aber, dass sein Gewand schön ist und dass seine Schuhe schön sind". Er (d. h. der Prophet (s.a.s.) sagte: "Allah ist schön und Er liebt die Schönheit. Hochmut aber ist, wenn man das Recht (bzw. die Wahrheit) missachtet und die Menschen geringschätzig betrachtet"."

Die Meinungen der Gelehrten des Islam über Musik und Gesang:
Al-Qāşim sagte: „Singen ist ein Teil der Falschheit." Al-Ĥaşan al-Başrī sagte: „Wenn du zu einem Abendessen eingeladen wirst, bei dem Musik gespielt wird, dann lehne die Einladung ab." [al-Djāmi' von al-Qairawānī, S. 262-263].
Scheich al-Islam Ibn Taimiyah sagte: „Die Ansicht der Imāme der vier (bekannten) Rechtsschulen ist, dass alle Arten von Musikinstrumenten verboten sind. In Şaĥīĥ al-Buchārī und weiteren wird berichtet, dass der Prophet – möge Allah ihn loben und Heil schenken – sagte, dass es in seiner Ummah (Nation/Gemeinschaft) solche geben wird, die Zinā, Seide, Berauschendes und Musikinstrumente für erlaubt erklären, und er sagte ebenfalls, dass diese in Affen und Schweine verwandelt werden […]. Keiner der Anhänger der vier (bekannten) Rechtsschulen erwähnt eine Uneinigkeit bezüglich Musik." [al-Madjmū', 11/576].
Al-Albānī sagte: „Die vier Rechtsschulen sind sich einig, dass alle Musikinstrumente verboten sind." [aş-Şilşilah aş-Şaĥīĥah, 1/145]
Ibn al-Qayyim sagte: „Der Madhhab (Lehrmeinung) von Abu Ĥanīfah ist am strengsten in dieser Angelegenheit, und seine Äußerungen gehören zu den schärfsten. Seine Gefährten sagen eindeutig, dass das Hören gleich welcher Musikinstrumente, wie zum Beispiel Flöte oder Trommel, selbst das (rhythmische) Klopfen eines Stockes, verboten (Ĥarām) ist. Ihrer Meinung nach ist dies eine Sünde, die zeigt, dass eine Person ein Fāşiq (Sünder, Übertreter) ist, dessen Zeugnis nicht akzeptabel ist. Einige gingen sogar noch weiter, indem sie sagten, dass Musik zu hören Fişq (Sünde, Übertretung), und sich daran zu erfreuen Unglaube (Kuffr) ist. Das sind ihre Worte. Zur Unterstützung dieser Ansicht führen sie einen Ĥadīth an, der allerdings nicht dem Prophet – möge Allah ihn loben und Heil schenken – zugeschrieben werden kann. Sie sagten, wenn er daran vorbeikommt oder es in seiner Nachbarschaft ist, sollte er das Hören so gut es geht vermeiden. Abu Yūşuf sagte über ein Haus, aus dem der Klang musikalischer Instrumente zu hören ist: „Betrete es ohne Erlaubnis, denn schlechte Handlungen zu unterbinden ist eine Pflicht, und wenn der Eintritt ohne Erlaubnis nicht gestattet wäre, könnten die Leute dieser Pflicht nicht nachkommen." [Iĝāthat al-Lahfān, 1/425].
Imām Mālik wurde nach dem Spielen einer Flöte oder Trommel gefragt, wenn eine Person dies unbeabsichtigt hört und sich daran erfreut. Er antwortete: „Wenn er merkt, dass er sich daran erfreut, sollte er aufstehen, es sei denn, dass er aufgrund einer Notwendigkeit sitzt oder nicht in der Lage ist, aufzustehen. Wenn er sich auf der Straße befindet, sollte er entweder zurück- oder weitergehen." [al-Djāmi' von al-Qairawānī, S.262].
Er sagte: „Unserer Ansicht nach sind die einzigen Leute, die so etwas tun, Fāşiqīn." [Taffşīr al-Qurtubī, 14/55].
Ibn 'Abdulbarr sagte: „Unter den Arten von Einkommen, die gemäß dem Konsens der Gelehrten verboten sind, sind Ribā (Zinsen), das Geld für eine Prostituierte, alles, was verboten ist, Bestechungen, die Bezahlung für das Weinen über einen Toten [*] und Singen, Geld für den Wahrsager und diejenigen, die behaupten, das Verborgene zu kennen, die Bezahlung für das Spielen einer Flöte und jede Art von Glücksspiel." [Siehe al-Kāfī].
Ibn al-Qayyim sagte, indem er den Standpunkt von asch-Schāfi'ī erläuterte: „Seine Gefährten, die seine Madhhab (Lehrmeinung) kennen, sagen, dass es verboten ist und verurteilten diejenigen, die es für erlaubt ansahen." [Iĝāthat al-Lahfān, 1/425].
Der Autor von „Kifāyat al-Achbār", der ein schāfi'ītischer Gelehrter war, zählte Musikinstrumente, wie Flöten und andere, zu Munkar (schlechten Dingen), und wenn jemand dabei ist (wenn diese gespielt werden), sollte er sie öffentlich verurteilen. Er kann nicht durch die Tatsache, dass es einige verdorbene Gelehrte gibt (die etwas anderes sagen), entschuldigt werden, denn diese verderben auch die Scharī'ah, oder die üblen Bedürftigen – d.h. die Sufis, da sie sich selbst Bedürftige (Fuqarā`) nennen – da sie unwissend sind und jedem folgen, der den Mund aufmacht. Sie sind nicht durch das Licht des Wissens geleitet, vielmehr werden sie von jedem Wind hin- und hergewirbelt." [Kifāyat al-Achbār, 2/128].
Ibn al-Qayyim sagte: „Was die Meinung von Imām Aĥmad betrifft, so berichtete sein Sohn 'Abdullah: „Ich fragte meinen Vater nach Gesang." Er antwortete: „Gesang verstärkt nur die Heuchelei im Herzen. Ich lehne es ab." Dann erwähnte er die Worte Imām Māliks: „Nur die Sünder (Fāşiqīn) von uns tun das." [Iĝāthat al-Lahfān].
Ibn Qudāmah, der Forscher der ĥanbalitischen Rechtsschule, sagte: „Musikinstrumente sind von drei Arten, die verboten sind. Dies sind Seiteninstrumente und Flöten, die Laute, die Trommel, Rabaab (ein Seiteninstrument) usw. Wer unbeirrt daran festhält, diese zu hören, dessen Zeugnis sollte abgelehnt werden." [al-Muĝnī, 10/173]
Und er sagte: „Wenn jemand zu einer Versammlung eingeladen wird, in der es etwas Anstößiges gibt, wie Wein oder Musikinstrumente, und er kann diese Leute anklagen, sollte er hingehen und etwas gegen diese Leute sagen, da er in diesem Fall zwei Pflichten erfüllt. Wenn er dies nicht kann, sollte er nicht hingehen." [al-Kāfī, 3/118].
At-Tabarī sagte: „Die Gelehrten von überall sind sich einig, dass Singen nicht empfohlen (Makrūh) ist und dass es unterbunden werden muss. Obwohl Ibrāhīm Ibn Ş'ad und 'Ubaidullah al-'Anbarī eine Ausnahme von der Mehrheit sind, (sollte man beachten, dass) der Gesandte Allahs – möge Allah ihn loben und Heil schenken – sagte: „Haltet euch an die Mehrheit. Und wer stirbt während er mit der großen Mehrheit uneins ist, stirbt als Unwissender (Djāhil)." [Taffşīr al-Qurtubī, 14/56].
Bei den früheren Generationen wurde das Wort „Makrūh" für etwas Verbotenes verwendet. Später bekam es die Bedeutung von „nicht empfohlen". Hier aber muss es als verboten verstanden werden, da at-Tabarī sagte: „[…] und dass es unterbunden werden muss.", und nichts außer dem Verbotenen muss unterbunden werden, und da es in den beiden zitierten Ĥadīthen aufs Schärfste verurteilt wird. Al-Qurtubī erwähnte diese Überlieferung und fügte hinzu: „Unter unseren Gefährten sagen Abu al-Faradj und al-Qaffāl, dass das Zeugnis eines Sängers und Tänzers abzulehnen ist. Ich sage: wenn es erwiesen ist, dass diese Sache nicht erlaubt ist, dann ist Geld dafür zu nehmen ebenfalls nicht erlaubt."
Scheich Fauzān sagte: „Was Ibrāhīm Ibn Ş'ad und 'Ubaidullah al-'Anbarī über Gesang sagten, bezieht sich nicht auf Gesang heutiger Art. Diese Art von Gesang, die der Gipfel von Unmoral und Obszönität ist, hätten sie niemals erlaubt."
Der große Gelehrte Ibn Taimiyah sagte: „Es ist nicht erlaubt, Musikinstrumente herzustellen." [al-Madjmū', 22/140]. Und er sagte weiter: „Gemäß der Mehrheit der Gelehrten ist es erlaubt, Musikinstrumente, wie den Tanbur (Instrument ähnlich einer Mandoline), zu zerstören. Dies ist die Ansicht von Mālik und die bekanntere von zwei von Aĥmad überlieferten Meinungen." [al-Madjmū', 28/113].
Und weiter: „[…] Ibn al-Mundhir schrieb, dass die Gelehrten sich einig sind, dass man niemanden für Gesang und Jammern bezahlen dürfe. Der Konsens aller Gelehrten, von deren Meinung wir gelernt haben, über Singen und Jammern ist, dass sie nicht erlaubt sind. Asch-Schu'bī, an-Nacha'ī und Mālik betrachteten es als Makrūh (d.h. Ĥarām). Abu Thaur, an-Nu'mān, Abu Ĥanīfah, Ya'qūb und Muĥammad, zwei Schüler von Abu Ĥanīfah, sagten: „Es ist nicht erlaubt, für Singen und Jammern zu bezahlen. Dies ist auch unsere Ansicht." (Und er schrieb weiter:) „Musikinstrumente sind der Wein der Seele, und was sie in der Seele anrichten ist schlimmer als das, was berauschende Getränke anrichten." [Madjmū' al-Fatāwah, 10/471].
